📜 Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and LockFastPro Inc. ("LockFastPro", "we", "our", or "us"), governing your use of the LockFastPro mobile application, website at lockfastpro-landing.onrender.com, and all related services (collectively, the "Platform").

By creating an account, downloading the app, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not use the Platform. You must be at least 18 years of age to create an account or use LockFastPro.


🏪 The Platform

LockFastPro is a two-sided marketplace that facilitates connections between individuals who need locksmith services ("Customers") and independent, self-employed locksmith professionals ("Service Providers" or "Locksmiths"). LockFastPro is a technology platform only — we do not employ locksmiths, and we are not a locksmith service company.

Important: LockFastPro does not provide locksmith services directly. Service Providers are independent contractors, not employees or agents of LockFastPro. Any contract for locksmith services is formed directly between the Customer and the Service Provider.

Your Rights & Responsibilities as a Customer

  • You may use LockFastPro to request locksmith services for legitimate, lawful purposes only.
  • You must be present at or authorize access to the property where services are requested.
  • By requesting a service, you confirm you have the legal right to grant access to the property (as owner, tenant, or authorized representative).
  • You are responsible for providing accurate service location and contact information.
  • You agree to pay the quoted or final price for services rendered, including any applicable taxes.
  • You agree to treat Service Providers with respect and professionalism.
  • You acknowledge that estimated arrival times are approximate and may vary due to traffic, demand, or other factors.

Booking & Cancellations

When you request a service, you will receive an upfront estimate based on service type and location. Final pricing may vary based on actual work required. Once a locksmith accepts your job and is en route, cancellations may incur a cancellation fee as displayed in the app at time of cancellation.

Reviews & Ratings

After a completed job, you may leave a rating and review of your Service Provider. Reviews must be honest, fair, and based on your genuine experience. We reserve the right to remove reviews that violate our community guidelines.

For Service Providers

Your Rights & Responsibilities as a Service Provider

  • You are an independent contractor, not an employee of LockFastPro. You control when and where you work.
  • You are solely responsible for the quality, safety, and legality of the services you provide.
  • You must hold and maintain a valid locksmith license as required by the applicable provincial or municipal authority.
  • You must carry and maintain adequate liability insurance as required to operate a locksmith business in your jurisdiction.
  • You are responsible for your own taxes, including remitting HST/GST if applicable, and for your own equipment, tools, and transportation.
  • You must promptly and honestly communicate with Customers through the platform's in-app messaging tools.
  • You must not perform services at a property unless you have confirmed authorization from the Customer.
  • You agree to maintain your service area, working hours, and pricing information accurately in your profile.

Onboarding & Verification

To become a Service Provider, you must complete our onboarding process, which includes identity verification, license validation, insurance confirmation, and a background check. We reserve the right to deny or revoke access to the Platform for any Service Provider who does not meet our standards.

Platform Commission

LockFastPro charges a platform fee on each completed job. The current fee structure is disclosed during onboarding and in your earnings dashboard. We reserve the right to modify fees with reasonable advance notice.

Deactivation

LockFastPro may suspend or permanently deactivate a Service Provider account for reasons including, but not limited to: low performance metrics, repeated cancellations, customer complaints, safety incidents, fraudulent activity, or violations of these Terms.


💳 Payments & Payouts

Customer Payments

All payments are processed through Stripe, Inc., a third-party payment processor. By adding a payment method, you agree to Stripe's Terms of Service. Charges are applied upon completion of a job. Prices include all applicable taxes unless otherwise stated.

Refunds

Refunds are evaluated on a case-by-case basis. If you are unsatisfied with a service, contact us at help@lockfast.ca within 48 hours of job completion. LockFastPro's decision on refund eligibility is final.

Service Provider Payouts

Earnings are disbursed to Service Providers via Stripe Connect direct deposits. Payouts are subject to the platform commission and any applicable processing fees. Payout schedules and minimum thresholds are displayed in the earnings dashboard. LockFastPro is not responsible for delays caused by banking institutions or Stripe processing times.


🤝 Community Standards & Prohibited Conduct

All users of LockFastPro must uphold a standard of respectful, lawful conduct. The following are strictly prohibited:

Violations may result in immediate account suspension, permanent ban, and referral to law enforcement where appropriate.


©️ Intellectual Property

All content, features, trademarks, logos, and technology of the LockFastPro Platform are the exclusive property of LockFastPro Inc. and are protected by Canadian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform without our express written permission.


⚖️ Limitation of Liability & Disclaimers

Important: LockFastPro is a marketplace platform only. We do not directly provide locksmith services and are not responsible for the actions, quality, safety, or conduct of Service Providers.

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

Limitation of Liability

To the maximum extent permitted by applicable law, LockFastPro Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform or any services facilitated through it, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) CAD $100, or (b) the total fees paid by you to LockFastPro in the 3 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless LockFastPro Inc. from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.


🇨🇦 Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the Arbitration Act, 1991 (Ontario), conducted in Toronto, Ontario, Canada.


📋 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform.
